OK , so a few weeks ago I was going around a roundabout when a car didn't stop and pulled out directly in front of me . I had no chance of stopping and hit the drivers side rear qtr.
The usual insurance claim has followed with the driver claiming I hit her , which technically I suppose I did as she ignored the rules of the road and put her car at 90 degree's directly in my path. Oh and she is now claiming personal injuries from the impact.
It appears the current rules of insurance in the UK is that unless there are numerous witnesses both drivers are to blame . Therefore as much as I loathe the camera on the helmet look , after being knocked off and subsequently told it was partially my fault I feel the need for video evidence is required from now.
Therefore anyone got any experience bike camera's and willing to recommend , or a list of pointers I need to consider , quality required etc
I would prefer something that is activated with the starting of the bike so as I don't forget to switch it on , and also something that could be swapped between bikes, as I have a few.
The only one I have found upto now is this, anyone got any experience of these ?

Oh and a word of warning.
My bike sustained minimal damage , mainly due to meeting the tarmac , usual pegs/levers/fairing/paint etc but due to part availability it looks like it may get written off.

Who said it was partly your fault ?
I ended up suing a guy who U turned causing an accident. I only sued for £50 (my excess) but in wining it meant I also got the insurance settled. _________________ Don't read everything you believe |

The insurance are saying that unless I have a few witnesses to back up my account of the accident, even though she did not follow the rules of the road, ie give way to the right, it goes 50/50. I suppose the insurance win as we both lose no claims and they don't have the cost of trying to prove who is wrong.
Not happy at all !!!! I end up with a damaged ankle from being thrown down the road, scuffed leathers and boots and she has the nerve to claim for an injury !!!! Really pissed off . |

Vort28,
First, I am glad you are OK. I have been riding for over 38 years and have had my share of on-road spills and collisions and there but for the grace of God, I am still here in one piece to write this reply.
Here in the states, specifically Southern California, it is us against the "cagers". They typ. hit motorcyclists who are then generally thrown from the bikes and if we are very very lucky, we don't get run over by them or the other idiots around us (and die)...all of whom are either on their phones, eating, reading the paper, brushing their teeth, shaving, putting on makeup...(you get the picture).
Re: the "total loss" potential, I would say that you can negotiate with your insurance to prevent a "salvage" title. If they want to "write it off" but agree not to change the title (which over here means no full-coverage insurance available), perhaps you can "buy it back" for a small amount.
Re: your aggressor claiming "injuries", I would like to see that go before a Judge, especially if you can present pictures of your bike, her car, your gear and the traffic circle/road conditions. Judges like irrefutable evidence and you should be able to slam her and have her pay ALL of your recovery expenses. Call it the "being stupid repayment plan".
We all do stupid things from time to time but when on a bike, there is no room for error. I try to remember to never assume anything, expect that the cagers are actively trying to kill me and at the least can't see me even if I was right in front of them.
I hope this works out for you and stay safe as the alternative sucks. |

Fish, I'm with you.
I think every car driver should be taken out on a bike as part of their training to show them how dangerous the road is without that steel cage around them , and then maybe they will pay more attention to the road.
quikduk - much the same in the UK really, still waiting to see what price's they come up with. Issue is that with no parts available they don't know what to cost it up to either.
To be honest I don't want it written off , but then I have to many projects on the go to have it sat in the garage for years whilst I search ebay for parts but will depend on figures at the end of the day. |

Do you have any pictures of the scene after the accident ?
The insurance won't do anything unless you insist on it because they'll see as a potential cost. If you have legal cover they might have gone ahead but if you have a picture of where the car is after the accident you would have a case. if you feel strongly about it and have no pictures go back to the scene and take some. Make a diagram of what happened and take her to court. She caused the accident afterall. _________________ Don't read everything you believe |

Pictures are key.
Iv been rear ended 3 times now (phnar phnar) and reversed into, in a carpark whilst stationary behind a car.
First thing I do is whip the phone out and get pictures of the scene before anything moves, etc etc. Worth their weight in gold. _________________ Si...

Glad you are okay Vort. Has the world gone completely mad?
I always thought roundabout rules were clear cut? Here in Australia they read:
Before entering a roundabout, you must give way to any vehicle already in the roundabout. (that includes the motorcycle lodged in your rear quarter panel)
Also, I have found in the past that the insurance companies present themselves as the court and judge, but this is not the case. They don't preside over the road rules or the laws, the courts do. Take the insurance company to fairclaims if you have such a thing over there?
I think dash cams are just about essential. A lot of guys over here ride with gopro's behind the screen. If you have more than one bike you want something that can easily moved from one machine to the other.
End of the day, ring the insurance company and let them know that you are not going to bullied, and you will take it to them. |

Cameras on helmets.......one word......Schumacher!!!
Helmets are designed to protect your head, not to mount cameras on them.
If you get one, mount it on the bike👍 |

Have plenty of pictures after the accident but none that show the accident.
Upto now the insurance been crap, they out source the claims to a specialist company that obviously get paid per case so just want to bat it off and say 50/50 and get their fee.
I was hoping the assessor report of the damage may make the insurance company take note and fight but the assessor come back and said he can't find any info on Bimota in his quotation books and can't find anything on the interweb so throw it back to me to sort out .
The car damage is sub £1k ( rear bumper and rear qtr )and I need new levers/pegs/bar/engine casing , LH carbon fairing panel / nose cone and headlight + other bits , obviously other than the peg and casing , nothing else is available .
Told the assessor this and he basically asked me to guess a cost for parts , luckily I have found a replacement bike down south so the assessor now has a market value of mine.
But all work I have had to do , insurance is useless.
Do plan to ride with a camera from now, but know what I am like, and will either forget to switch it on, forget to charge it , or just forget it full stop. Hence the looking for one that is bike mounted but switchable between bikes as I generally only have 2 or 3 on the road each year. |

What you will need is a professional assessor (sounds like it would be an estimator in the states) to write you an estimate. In the Sates, or at least in California, your insurance company is obligated to settle your claim. Whether that settlement will be fair is a different story. As such, insurance co must provide you with an accurate estimate. If parts are n.a, this would usually result insurance company declaring the vehicle a total loss. You have an option to release your vehicle to insurance for the full loss value or retain the vehicle and get the balance of the settlement. The other option is what I think Quikduk is referring to is to negotiate the maximum repair amount or "locked estimate". Insurance companies are not too keen on this last option as it leaves room for improper repairs.
If your ins company can't provide you with a repair estimate you may consider having a local motorcycle repair shop or an independent appraiser, err assessor do one for you. It will cost you a few quid but that expense should also be covered by insurance company. Of course, you should contact your insurance company to advise them and get them to agree to review and accept your estimate. _________________ 1991 Bimota YB10

Sorry to hear that it's not going so well Stu. I'd be super pissed too. We pay ridiculous money for insurance, hoping that we never need it, but also hoping that they will look after us if the worst happens.
